Industrial terms and conditions

Terms and conditions will vary depending on the type of job and award.

Hours and working conditions

Working hours and conditions can vary depending on the type of job, whether the job is part or full time, the time of year (eg daylight saving, seasonal work etc.) and the work volume. The relevant industrial award will include overtime and personal and sick leave provisions.

Rates of pay

The usual rates of pay for industrial employees will vary according to:

Work on Sundays or public holidays is generally paid at double time while other overtime is paid at time and a half. Anyone employed on an hourly basis must be paid for overtime, while weekly and part-time employees may choose to be paid at the appropriate overtime rate or receive time off with pay equal to the overtime worked.

Written work agreements

All workers must reach an agreement with their employer on the terms and conditions of employment before starting work. The agreement is then put into writing, signed by both parties, and the employee is given a duplicate copy. The work agreement protects the rights of both employee and employer in case of a dispute. Because of this, it is important to make sure that both the employer and employee signatures appear on both copies, along with signatures of witnesses.

Any employee who experiences a crisis beyond their control such as personal or family sickness, an accident or death in the family has the right to terminate their work agreement without notice. However, it is recommended that permission be obtained to leave work in order that wages are not forfeited.

(Note: The work agreement form will vary according to the type of job.)
